6183 sayılı AATUHK’da, tahsil aşamasına gelmiş kamu alacağının iki fıkra halinde düzenlenmiş hareketler ile tahsilinin engellenmesi karşılığında ceza yaptırımı öngörülmüştür. Bu suçun soruşturulmasına başlanabilmesi için, mahalli en büyük memurunun ihbarı gerekmekle birlikte, ayrıca objektif cezalandırılabilme şartı da aranmaktadır. Çalışmada, bu suçun unsurları, AATUHK’nın 30. Madde ile olan ilişkisi, İcra ve İflas Kanunu’nda düzenlenen benzer yaptırım ile farklılıkları incelendikten sonra bu suçun vergi inceleme aşamasında da tespit edilebileceği açıklanmaya çalışılmıştır. Bu kapsamda, bu suça karşı mücadelenin daha etkin ve hızlı yapılabilmesi amacıyla çözüm önerileri sunulmuştur.
In the Law No. 6183, penal sanction was envisaged in return for preventing the collection of public revenues, which have come to the stage of collection, with actions arranged in two paragraphs. In order to start the investigation of this crime, it is necessary to notify the highest local official, but also the condition of being able to be punished objectively. In the study, after examining the elements of this crime, the relationship of the Law No. 6183 with Article 30, the differences with the similar sanction regulated in the Law No. 2004, it has been tried to explain that this crime can also be detected at the tax inspection. In this context, solution suggestions have been presented in order to make the fight against this crime more effective and faster.
