Mükelleflerin vergiye esas kazançlarını tespit ederken tereddüte düştüğü hususlardan bir tanesi olan tasfiyesi zararla sonuçlanan iştirake ilişkin kayıtlı bedellerin nasıl bir işleme tabi tutulacağı hususu uygulamada da tartışma konusu olmuştur. Bu bedellerin mali karın tespitinde dikkate alınması gerektiği yönündeki görüşünü yakın zamanda değiştiren Maliye İdaresi vermiş olduğu özelgelerde anılan bedellerin ticari (kurum) kazançtan indirilmesinin vergi kanunlarında özel bir hüküm bulunması halinde mümkün olacağını ifade etmiştir. Bununla birlikte bu görüşe, mükelleflerce katlanılan bu zararın ticari hayatın olağan akışı içinde olduğu bu nedenle de ticari faaliyetin idame ettirilmesi için yapılan bir gider niteliği taşıdığı dolayısıyla da vergiye esas karın belirlenmesinde dikkate alınması gerektiği yönünde görüş bildiren kimseler de bulunmaktadır. Burada dikkat edilmesi gereken husus ticari hayatta yaşanabilecek her türlü durumun mali karın tespiti noktasında bir etkisi olmayabileceği ve sermayenin kendisinde yaşanan kayıpların vergi kanunlarınca özel bir hüküm vazedilmediği sürece zarar olarak kabul edilmemesi zorunluluğudur.

In addition, there are people who claim that this loss incurred by taxpayers is in the ordinary course of business, therefore it is qualified as an expenditure made to maintain business activities and thus it must be considered in the determination of the principal profit. The issue to pay attention to here is that any situation that may arise in business life may not have an impact in the determination of financial profit, and it is obligatory not to consider the losses incurred in the capital itself as losses unless there is a specific provision in the tax laws.
