TARIMDA ÇALIŞAN BAYANLARA GERİYE DOĞRU BORÇLANARAK EMEKLİ OLMA HAKKI GELDİ

ÖZET
Tarımda bağımsız çalışan kadın sigortalılardan aile reisi olmayanlar prim tevkifatına göre 02.08.2003 tarihinden önceki süreleri hizmet olarak kazanamıyorlardı. SGK’nın bu uygulaması, 26.01.2012 tarihli ve 6270 sayılı yasayla sona ermiştir. 6270 sayılı yasayla birlikte kadın çiftçilerimiz, prim tevkifatına göre aile reisi olma şartı aranılmadan 02.08.2003 tarihinden önceki süreleri hizmet olarak kazanabilecek ve diğer şartlarının tutması halinde emekli olabileceklerdir. Ayrıca, 6270 sayılı yasadan önce, kadın çiftçilerimizde 22 yaşından küçükken yapılan prim tevkifatına göre geriye dönük sigortalılık süresi verilmiyordu. 6270 sayılı yasayla, 02.08.2003 tarihi öncesi için sigortalı sayılma yaş şartı 22’den 18’e çekilmiştir. Bu nedenle, kadın çiftçilerimiz 18 yaşını doldurduğu tarihten sonra kendilerinden Bağ-Kur/SGK adına tevkifat yapıldığını SGK’ya müstahsil makbuzlarıyla kanıtladıklarında, sigortalılık başlangıcını 22 yaşından öncesine götürebilecek ve 18 yaşından sonraki süreleri hizmet olarak kazanabileceklerdir.

RIGHT TO RETIRE THROUGH RETROSPECTIVE BORROWING FOR THE WOMEN AGRICULTURAL WORKERS
ABSTRACT
In the past, the independent women agricultural workers who have insured employment and who are not head of a family cannot gain the periods before 02/08/2003 as service according to the premium withholding. This application of SSI came into end with the law dated 26.01.2012 and no. 6270. According to the law no. 6270, women farmers can gain the period before 02/08/2003 as service without condition to be a head of a family according to the premium withholding and they can retire on condition to meet the other conditions. Besides, before the law no. 6270, retrospective insurance period could not be given to the women farmers according to the premium withholding performed before the age of 22. With the law 6270, the age condition for being accepted as insured before 02/08/2003 has been decreased from the age of 22 to 18. Therefore, in the event that women farmers demonstrate to SSI that a withholding was made from themselves on behalf of Bağkur (Social Security Organization for Artisans and the Self-Employed/Freelancers)/SSI after the date they become 18 with their producer receipts, they can make the insurance start before the age of 22 and gain the periods after the age of 18 as service.
