ÖZET

Katma Değer Vergisinde (KDV) tam istisna niteliğindeki işlemlerle ilgili KDV’deki hesaplanan-indirilen zincirinde indirim yoluyla giderilemeyen KDV, iade konusu yapılabilir. Tam istisna kapsamında olan ihracat istinasından kaynaklanan KDV iadesinin hesaplanmasında 60 Nolu KDV Sirküleri üst sınır belirlemiştir. Buna göre malın temini dolayısıyla KDV yüklenimi olmayan ihracatçının genel giderler ve amortismana tabi iktisadi kıymet (ATİK) alımları nedeniyle yüklenilen vergileri iade edilebilir. Ancak iade edilecek tutar, malın ihracat bedeli ile o malın ihraç kayıtlı teslim bedeli arasındaki farkın genel vergi oranı ile çarpılması sonucu bulunacak tutardan fazla olamaz. Böylece ihracat yapan mükelleflerin, genel giderler ve ATİK alımları nedeniyle yüklendiği KDV’nin iadesinde üst sınır belirlenmiştir. Üst sınır dolaysıyla iade alınamayan KDV tutarı, tam istisnaya konu başka bir işleme ait KDV iade hesaplama yönteminin değiştirilmesi ile geri alınamaz.

CAN FEES WHICH ARE BEYOND THE UPPER LIMIT BE RETURNED BY CHANGING THE CALCULATION METHOD IN VAT RETURNS DUE TO EXPORT EXCEPTION?

ABSTRACT

The VAT that cannot be eliminated by reduction in the calculated-reduced chain in the VAT regarding the operation which have the quality of full exception in Value Added Tax (VAT). VAT Circular no. 60 has established an upper limit in the calculation of VAT due to export exception which is within the scope of full exception. Accordingly, the taxes assumed by the exporter who does not have VAT burden for the supply of the good due to general expenses and purchases of economic assets subject to depreciation. However, the sum to be returned cannot exceed the amount that will be found by multiplying the difference between the export value of the good and export registered delivery price of that good with the general tax rate. Therefore, an upper limit has been established in the return of VAT which the taxpayers who export bear due to general expenses and purchases of economic assets subject to depreciation. The VAT amount that cannot be returned due to upper limit cannot be returned by changing the VAT return calculation method for another operation.
