DEFTER VE BELGELERİN VERGİ İNCELEMESİNDE GİZLENEREK İDARİ YARGI MERCİİNE İBRAZ EDİLMESİ “TERCİHİ”

ÖZET

Bu çalışmada, incelemeye yetkililere ibraz edilmeyen defter ve belgelerin mahkemeye ibrazının vergi inceleme sonucuna etkilerine ilişkin yargı kararlarında benimsenen yaklaşımlar incelenmiştir. Bu bağlamda, mahkemeler, söz konusu defter ve belgeler üzerinde bilirkişiye veya vergi idaresine yaptırılan tespitler üzerine dava konusu tarhiyatların kaldırılması yönünde kararlar verildiği görülmüştür. Belirtilen yaklaşımlar, dava konusu işlemlerin biçimsel olarak sorgulanmasıyla yetinilerek gerçek durumun irdelenememesi, inceleme yetkisinin aracı vasıtasıyla kullanımı, zamanaşımı hükümleri ve tespitlerin dava konusuyla sınırlandırılması gibi unsurlar yönüyle vergi hukuku düzenlemeleriyle uyum göstermemektedir. Diğer yandan, defter ve belgelerin incelemeye ibraz edilmemesi fiili kaynaklı olarak tarh edilen vergi ve kesilen cezaların ibrazın mahkemeye yapılması suretiyle kaldırılması, mükellefin hukuka uygun olmayan davranışının maddi müeyyideden yoksun kalmasını sağlayacaktır. Bu durumda, bazı yargı kararlarında rastlanıldığı üzere, gizleme fiili kaynaklı olarak tarh edilen vergi ve cezalara karşı açılan davalarda; ibraz zorunluluğuna uymamanın Vergi Usul Kanunu’nda düzenlenen haklı bir nedene dayanıp dayanmadığının yargılamanın esas konusu olarak değerlendirilmesi, haklı neden bulunmaması halinde defter ve belgelerin ispat aracı olarak dikkate alınmaması yönündeki yaklaşımın vergi hukukunun gereği olduğu değerlendirilmektedir.

“OPTION” OF SUBMITTING BOOKS AND DOCUMENTS TO ADMINISTRATIVE JUDICIAL AUTHORITIES AFTER CONCEALING THEM IN TAX INSPECTIONS

ABSTRACT

This study addresses the approaches adopted in judicial decisions related to the effects on the tax inspections results of submitting books and documents to the court, which have not been submitted to the authorities for inspection. Accordingly, it has been observed that the courts ruled to remove the assessment amounts in dispute, based on the findings of the experts or the tax administration regarding the mentioned books and documents. These approaches do not comply with the tax law regulations in view of the factors such as the failure to inspect facts by considering the formal examination of the proceedings in dispute as sufficient, enforcement of the inspection power through an intermediary, provisions on the statute of limitations and limiting the findings only to the subject matter of the case. Moreover, not submitting books and documents for inspection, and removing fines imposed and taxes assessed as a result of acts following the submission of these to the court will result in failure to subject the unlawful behavior of the taxpayer to pecuniary sanctions. Under these circumstances, as it is seen in some judicial decisions, in the cases filed against taxes and fines assessed as a result of the act of concealment, approach of considering whether the failure to comply with the obligation of submission is based on a just cause regulated in the Tax Procedure Law or not as the main subject of the trial, and when there is not any just cause, not considering the books and documents as proofs is deemed to be a requirement of tax law.
