2017 yılında gerçekleştirilen anayasa değişiklikleri ile Türkiye’nin yönetim sistemi değişmektedir. Bu değişikliklerle parlamenter sistemden cumhurbaşkanlığı hükümet sistemine geçilmektedir. Yeni yönetim sisteminde yürütme işlevi tek başına cumhurbaşkanı tarafından icra edilecektir. Yeni düzenlemeler vergi hukukunun halen kullanılan bazı kaynakları üzerinde de sonuçlar doğuracaktır. Yeni anayasaya göre bir düzenleme aracı olarak cumhurbaşkanlığı kararnameleri gündeme gelecektir. Vergi hukukunun mevcut kaynaklarından bazıları ise yeni yönetim sisteminin bir sonucu olarak işlevini yitirecektir. Örneğin yeni dönemde bakanlar kurulu kararları ya da tüzük gibi kaynaklar kullanılmayacaktır. Bu makalenin amacı, yukarıda değinilen değişikliklerin ana hatları ile açıklanmasıdır.
With the amendments to the constitution in 2017, Turkey’s administration system is changing. These changes lead to a transition from the parliamentary system to the presidential system. In the new administration system, the executive function will be exercised by the president alone. The new regulations will also have consequences on some of the resources currently used in the tax law. According to the new constitution, presidential decrees will come into the agenda as a means of setting a rule. Some of the existing sources of tax law will lose their function as a consequence of the new administration system. For example, in the new period resources such as ministerial council decisions or regulations will not be used. The purpose of this article is to explain the outlines of the changes mentioned above.
